CONDITIONS FOR CRAFTSMANSHIP

 

DEFINITION OF CRAFTSMAN

 

-Belonging to tradesmen and craftsmen professions,
-Bases its economic activity on physical work along with its capital, 
-Earnings that do not qualify as a merchant or industrialist, 
- Taxed in a simple manner or exempt from tax,
-Professional and artistic people who are subject to the books in business procedures. 


ROOM REGISTRATION


Tradesmen and craftsmen are obliged to register their status with the registry they are affiliated with within thirty days from the date they start working. Those who are found to have not fulfilled this obligation are reported by the union to the relevant institutions and organizations authorized to issue licenses. Relevant institutions and organizations stop their activities until the registry is made. 
If the member has a fixed workplace; to the room where the workplaces are located 
If the member does not have a fixed workplace: he/she is registered in the room where his/her legal residence is located.
It is not possible to register to the chambers of tradesmen and craftsmen and the chambers of commerce and industry due to the same profession. Members who are registered in the registry for more than one profession are registered separately in the relevant chambers of expertise and the registration fee is collected separately for each profession. 
Municipalities; In order to issue a license, tradesmen and craftsmen who want to open a business or engage in professional activities must request a registry certificate and a document from the relevant chamber proving that they are members. Public institutions and organizations, municipalities, public economic enterprises, tradesmen and craftsmen credit and guarantee cooperatives and banks must request the relevant chamber document proving that they are members in license, tender and loan transactions regarding chamber members.
In this respect, it will be necessary to understand the public institutions and organizations to be applied when opening a business from the expression "relevant institutions and organizations authorized to issue licenses". When opening a business, necessary permits and licenses are obtained from public institutions such as the tax office, relevant municipality, Social Security Institution, İş-Kur and registration is made.
Chamber members can also register to the stock exchange if they buy and sell goods subject to the stock exchange due to their profession. 


MEMBERSHIP TERMS


The following conditions are required for chamber membership:
To be a citizen of the Republic of Turkey or to be a foreign national and to be engaged in art and trade in Turkey.
Having the capacity to exercise civil rights.
Being a taxpayer or being tax-exempt.
Not being registered in the chambers within the Union of Chambers and Commodity Exchanges of Türkiye


TO DELETE MEMBERSHIP RECORDS

 
-The member permanently leaves the working area of the room,
- Loses any of the membership conditions or is later understood to not have any of these conditions,
-Disqualification from profession, 
-If the tax liability is not re-established within six months, it will be deleted by the decision of the board of directors.


CRAFTSMAN-TRADER DIFFERENCE 


Consensus committees are established in provinces and districts to resolve disputes that may arise between the chambers subject to Law No. 5362 or between these chambers and the chambers within the Turkish Union of Chambers and Commodity Exchanges regarding the membership registration obligation.
In order to resolve disputes between the chambers of tradesmen and craftsmen regarding the obligation to register members, a committee is formed in the provinces and districts under the chairmanship of the civil administrator, with the participation of one representative of the relevant chambers and the Union.
If the membership dispute is between the Chambers of Tradesmen and Craftsmen and the chambers within the Union of Chambers and Commodity Exchanges of Turkey; A committee is formed under the chairmanship of the civil chief, with the participation of the Union in the provinces, the relevant chamber and the chambers of commerce and industry in the districts. 
Those concerned may appeal against the committee's decisions to the competent Civil Court of First Instance within ten days. The court's decision is final. Upon the final court decision, the relevant registry offices must take the necessary action in their records.
